Terms of Service

These Terms of Service ("Terms") govern your access to and use of the 1INAIwebsites, portals, APIs, dashboards, AI tools, data services, and related services (collectively, the "Service"). The Service is operated by 1INAI ("we", "us", or "our"), based in New Zealand. By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Our Services
1INAI provides AI-powered content creation and business automation tools, including campaign building, image generation, video generation, voiceover synthesis, AI copywriting, custom AI agents, business automation workflows, admin tooling, APIs, and related reporting.
Some features may be free, experimental, invite-only, in beta, or available only to approved users or paid customers. We may add, change, suspend, or remove features at any time, including where required for security, reliability, commercial, legal, or operational reasons.
2. No Professional Advice
NOTHING IN THE SERVICE CONSTITUTES FINANCIAL, INVESTMENT, TAX, LEGAL, ACCOUNTING, OR OTHER PROFESSIONAL ADVICE. AI-generated content, campaign suggestions, agent responses, and other outputs are provided for informational and creative purposes only. You must independently verify any content before using it for business, legal, or commercial purposes.
We do not recommend that you rely on AI-generated outputs for decisions that involve significant financial, legal, or regulatory risk. You are solely responsible for your own decisions, research, risk assessment, and use of generated content.
3. AI Output Limitations
AI-generated content may contain inaccuracies, biases, outdated information, or outputs unsuitable for your intended use. You must independently verify all important information before relying on it. AI tools do not understand your full circumstances and should not replace human judgment or professional expertise.
Generated images, videos, voiceovers, and copy may not accurately represent real people, places, products, or facts. You are responsible for ensuring your use of generated content complies with applicable laws, platform policies, and third-party rights.
4. AI Outputs and Automation
AI-generated outputs may be inaccurate, incomplete, outdated, biased, or unsuitable for your intended use. You must independently verify important information before relying on it. AI tools do not understand your full circumstances and should not be treated as professional advice, a guarantee, or a substitute for human judgment.
Automated systems, agents, alerts, and workflows may experience bugs, downtime, data gaps, delayed execution, misclassification, rate limits, provider outages, or unexpected behavior. You are responsible for monitoring your own use of automated features and for any decision you make based on their outputs.
5. AI Agents and Automation
AI agents and automated workflows are designed to assist with business tasks such as lead qualification, content generation, and customer support. They do not replace human oversight. You remain responsible for reviewing, approving, and monitoring all agent outputs and actions.
Automated systems may experience errors, downtime, misclassification, or unexpected behavior. You are responsible for monitoring your use of automated features and for any decisions you make based on their outputs.
6. Prohibited Activities
You must not:
- use the Service for unlawful, deceptive, harmful, abusive, or fraudulent activity;
- use the Service to generate misleading, deceptive, or harmful content at scale;
- attempt to extract, copy, reverse-engineer, scrape, or infer our proprietary models, scoring systems, prompts, source code, datasets, or platform logic;
- resell, redistribute, sublicense, or commercially exploit Service outputs without written permission;
- overload, probe, bypass, or interfere with the Service, APIs, rate limits, authentication, security controls, or infrastructure;
- upload malware, harmful code, illegal content, or content that violates third-party rights;
- misrepresent your identity, permissions, affiliation, or relationship with 1INAI; or
- use the Service in a way that could damage 1INAI, our users, our providers, or market integrity.
7. Eligibility and Compliance
You must be at least 18 years old and legally able to use the Service in your jurisdiction. You must not use the Service if doing so would breach any law, regulation, sanctions rule, exchange control, securities law, financial services law, consumer law, tax law, or other requirement that applies to you.
The Service is not available to persons or entities subject to applicable sanctions, or to persons located in jurisdictions where the Service is prohibited. We may restrict, suspend, or terminate access where we believe legal, security, abuse, sanctions, or operational risk exists.
8. Accounts and Security
You are responsible for keeping your account, email, passwords, multi-factor authentication, devices, API keys, wallets, and access credentials secure. You must notify us promptly if you suspect unauthorised access or misuse.
You are responsible for all activity under your account unless caused by our breach of these Terms. We may suspend or restrict access to protect the Service, other users, or our systems.
9. Subscriptions, Plans, Payments, and Credits
Paid plans, subscriptions, API access, enterprise services, custom agents, support packages, and other commercial arrangements may be subject to additional written terms, order forms, usage limits, or pricing notices. If there is a conflict, the specific written commercial terms for that service will apply to that service.
Subscription billing. Unless stated otherwise, subscription fees are billed in advance on a recurring monthly basis and are non-refundable except where required by law or expressly agreed in writing. Your plan and included credits renew automatically each billing cycle unless you cancel before the renewal date.
Credit top-ups. We may offer one-time credit top-up purchases ("Quick Fuel") via Stripe. Top-up credits are added to your account balance immediately after successful payment. Top-up credits do not expire and are consumed after your monthly plan credits are exhausted. Top-up purchases are non-refundable except where required by law.
Launch promotions. From time to time we may offer launch promotions, discounts, or bonus credits. Promotional credits are applied to your account and consumed before paid credits unless stated otherwise. Promotions may be time-limited, usage-capped, or subject to additional terms displayed at the point of offer. We reserve the right to modify or withdraw promotions with reasonable notice.
Daily caps and fair use. To maintain service quality, we may enforce daily generation caps based on your plan tier. Free tier users are limited to 3 content generations per day. Paid plan users have higher daily caps aligned with their subscription level. We may throttle, queue, or pause generation during periods of high demand or provider outage.
Price changes. We may change pricing, plan inclusions, rate limits, or availability with reasonable notice where practical. Changes take effect at the start of your next billing cycle for subscriptions.
To the extent permitted by law, you acknowledge that any paid business, API, fund, white-label, automation, or enterprise use is acquired for business purposes and that consumer guarantees may not apply.
10. Acceptable Use
You must not:
- use the Service for unlawful, deceptive, harmful, abusive, or fraudulent activity;
- use the Service to generate misleading, deceptive, or harmful content at scale;
- attempt to extract, copy, reverse-engineer, scrape, or infer our proprietary models, scoring systems, prompts, source code, datasets, or platform logic;
- resell, redistribute, sublicense, or commercially exploit Service outputs without written permission;
- overload, probe, bypass, or interfere with the Service, APIs, rate limits, authentication, security controls, or infrastructure;
- upload malware, harmful code, illegal content, or content that violates third-party rights;
- misrepresent your identity, permissions, affiliation, or relationship with 1INAI; or
- use the Service in a way that could damage 1INAI, our users, our providers, or market integrity.
11. Intellectual Property
The Service, including its software, user interfaces, branding, designs, workflows, prompts, data transformations, scoring methods, models, agent configurations, generated insights, reports, documentation, and proprietary databases, is owned by 1INAI or its licensors. We reserve all rights not expressly granted to you.
Public blockchain data, public market data, and third-party data remain subject to their original ownership and availability. Our selection, enrichment, organisation, scoring, presentation, and analysis of that data are proprietary to 1INAI.
You may use Service outputs only for your own internal, lawful use unless we agree otherwise in writing. You may not use the Service or its outputs to build, train, benchmark, or improve a competing service without our written permission.
12. Customer Content and Feedback
If you submit prompts, files, messages, requirements, feedback, business data, or other content to the Service, you grant us the rights needed to host, process, transmit, display, and use that content to provide, secure, maintain, and improve the Service.
You represent that you have the rights needed to submit that content and that it does not violate law or third-party rights. Feedback may be used by us without restriction or payment to you.
13. Generated Content Storage and Retention
Storage duration. Generated content — including images, videos, voiceovers, avatars, copy, and campaign assets — is stored on our infrastructure for a period of 90 days from the date of generation. After 90 days, generated media files may be permanently deleted from our systems. You will receive a notification before deletion with an option to download your assets.
Extended storage. If you want to retain generated content for longer than 90 days, you may purchase extended storage on a subscription basis. Extended storage pricing is displayed at the point of purchase and billed monthly based on total storage volume. As long as your extended storage subscription remains active, your saved content will be retained. You may cancel extended storage at any time — upon cancellation, your stored content will be deleted after the next billing cycle unless you download it beforehand.
Storage tiers. Extended storage plans are available at the following tiers (pricing subject to change):
- Basic (1GB): Included with Pro plan — extends retention to 1 year
- Plus (10GB): Available as an add-on — permanent retention for up to 5,000 assets
- Premium (100GB): Available as an add-on — permanent retention for up to 50,000 assets
- Enterprise: Custom storage limits and retention periods — contact us for pricing
Your responsibility. We encourage you to download important generated assets to your own devices or cloud storage. We are not responsible for loss of content due to deletion under this policy, cancellation of extended storage, account termination, or service discontinuation. Free tier users have standard 90-day retention only. Paid plan users receive the storage allocation included in their plan, with the option to purchase additional extended storage as described above.
Backup and recovery. Generated content is stored on redundant infrastructure, but we do not guarantee that content can be recovered after deletion. You should maintain your own copies of important assets.
14. Third-Party Services and Data
The Service may rely on third-party infrastructure, AI providers, analytics providers, payment processors, cloud providers, APIs, and other external services. Third-party services may be inaccurate, unavailable, delayed, discontinued, rate-limited, or subject to their own terms.
We are not responsible for losses, errors, delays, outages, incorrect data, or other problems caused by third-party services.
15. Privacy
Our handling of personal information is described in our Privacy Policy. By using the Service, you acknowledge that we may process information as described there, including through cloud, analytics, infrastructure, and AI service providers.
16. Availability and Changes
The Service is provided on an "as is" and "as available" basis. We do not guarantee that the Service will be uninterrupted, secure, error-free, complete, current, or available in any specific location. We may perform maintenance, impose limits, or change how the Service operates.
17. Disclaimers
To the fullest extent permitted by law, we disclaim all warranties, representations, and conditions, whether express, implied, statutory, or otherwise, including warranties of accuracy, reliability, merchantability, fitness for a particular purpose, non-infringement, uninterrupted operation, or suitability for business, automation, or commercial use.
18. Limitation of Liability
To the fullest extent permitted by law, 1INAI and its officers, employees, contractors, suppliers, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or economic loss, including loss of profit, revenue, data, goodwill, opportunity, anticipated savings, or business interruption.
To the fullest extent permitted by law, our total aggregate liability for all claims relating to the Service or these Terms is limited to the greater of NZD $100 or the amount you paid us for the Service giving rise to the claim in the 12 months before the claim arose.
19. Indemnity
You agree to indemnify and hold harmless 1INAI and its officers, employees, contractors, suppliers, and affiliates from claims, losses, damages, liabilities, costs, and expenses arising from your use of the Service, your content, your breach of these Terms, your violation of law, or your violation of third-party rights.
20. Termination
You may stop using the Service at any time. We may suspend, restrict, or terminate your access at any time if we believe you have breached these Terms, created risk, caused harm, failed to pay fees, violated law, or misused the Service. Sections that by their nature should survive termination will continue to apply.
21. Governing Law
These Terms are governed by the laws of New Zealand. Subject to any mandatory law that applies, the courts of New Zealand have exclusive jurisdiction over disputes relating to these Terms or the Service. If any provision is unenforceable, the remaining provisions remain in effect.
22. Changes to These Terms
We may update these Terms from time to time. The updated version will be posted on this page with a revised effective date. Continued use of the Service after changes take effect means you accept the updated Terms.
